New Cayman Islands Constitution

The Cayman Islands adopted a new Constitution on Nov. 6, the first in almost 40 years, which gives more autonomy to the local government, more power over the police, names the leader of Government business a Premier, and generally empowers the local government. Cayman Islands is still an overseas territory of the UK, with more say in affairs that were in the past, and vested in Britain.

The modernization of the constitution was backed by voters in a May referendum and approved by U.K. officials in June. Most of the changes contained in Cayman’s first completely revamped governing arrangement with the United Kingdom since 1972 went into effect last Friday. Three prominent Caymanians will ascend to positions that had not previously existed in the Islands; those of the premier, deputy premier, and deputy governor.

As explained by CayCompass, the new constitution contains:

1. Significant Changes: The Cayman Islands Constitution Order, 2009, retains Cayman’s status as a British Overseas Territory with a governor appointed by Her Majesty, the Queen of England.

A number of changes have been made in the delegation of the governor’s current authority, essentially shifting more power to the elected government.

Unlike the current Constitution, this agreement allows the Premier (formerly the Leader of Government Business) to place items before Cabinet for consideration. The governor may also continue to bring items before Cabinet.

Another major change is that the United Kingdom will have to consult with Cayman’s elected lawmakers before international treaties that affect the Islands are finalised. A similar rule was put in place for orders^in^council issued by the UK.

A number of appointed councils, most visibly the National Security Council and the Judicial and Legal Services Commission will serve to dilute some of the governor’s power with regard to choosing judges and making strategic decisions for the police service.

Other new appointed bodies created under the Constitution include: the Human Rights Commission ^ which monitors and safeguards human rights, the Commission for Standards in Public Life ^ which is aimed at policing and preventing public corruption and the Constitutional Commission ^ which monitors legal and policy issues in Cayman’s governing document.

Under the new Constitution, the governor is generally obliged to follow the advice given by Cabinet unless he or she believes doing so would threaten the UK’s interests.

There will also be significant changes to the makeup of the Legislative Assembly. The Legislative Assembly will be the supreme law of the land under the new Constitution. The courts are not allowed to strike down laws if a judge rules a particular government action to be unconstitutional.

For the first time, people^initiated referendums are allowed under the Constitution. The laws governing such votes will make public petitions difficult to achieve, but they will be binding on the government if they are passed.

2. Bill of Rights: The Constitution identifies 19 separate individual human rights that will be observed in Cayman. These include the right to life, personal liberty, the right not to be tortured or enslaved, the right to a fair trial, of conscience and religion, free assembly, movement, the right of men and woman to marry, the right to property and the right not to be discriminated against. The Cayman Islands’ Bill of Rights will go into effect in November 2012.

3. New Premier: The longest^serving current member of the Cayman Islands Legislative Assembly ^ often called the “Father of the House” - William McKeeva Bush. He will oversee government business in the 50,000 territory of 50,000 residents, one of the world’s major tax havens.

“This post is not one of absolute power,” Bush said in a statement. “In contrast, it equates to being an engineer first, one selected from amongst equals.” deputy premier.

The London-appointed governor, Stuart Jack, said Friday’s commencement of the new constitution was the “highlight of my four years in the Cayman Islands.”

Cruise Tourism on St Kitts and Nevis Islands

The parade of cruise ships to St. Kitts’ Port Zante for November has begun, with the visit of the 92,000-ton Norwegian Jewel of the Norwegian Cruise Line (NCL). It was the first time that the Bahamas-registered cruise vessel, which has a passenger capacity of 2,376 passengers and a crew of 1,100 has visited St. Kitts.

According to information from the Marine Division of the St. Christopher Air and Sea Ports Authority (SCASPA), a total of 24 ships with an estimated capacity of 52,000 passengers are scheduled to berth on 25 cruise ship days in November.

Cruise tourism pumped US$44 million or EC$118 million into the St. Kitts and Nevis economy during the 2008/2009 cruise year, according to a study by the Florida-Caribbean Cruise Association. St. Kitts and Nevis led 24 of the 29 destinations in terms of average expenditure per cruise passenger of US$99.41 or EC$268.40.

Cayman Islands Marathon

The Cayman Islands Marathon will be held Dec. 6. Employees from the broadcasting company dms Broadcasting will take part in the four-person relay team category. They are encouraging other companies on the island to enter corporate teams as well to make the challenge even greater.

106.1 KISS FM has been the official radio station for the Cayman Marathon since 2006 and each year dms has entered a KISS team. This year the “Kiss n Run” team hopes to improve on its fourth place finish in the 2008 race and earn a spot on the awards stage while newbie team “Kiss n Tell” just wants to finish respectably.

“We’re all novice runners really but our goal is to get out there as a team, have lots of fun, improve our health along the way if possible and finish well,” says Richard Harrison who has competed as a member of Team “Kiss n Run” for the past three years.

Registration for the 2009 Cayman Islands Marathon, Half Marathon, Team Relay and Kids Fun Run is open online at CaymanIslandsMarathon.com. Walk-in registration can also be done at the Kelly-Holding office.

Air Carriers Compete for Travelers to Turks and Caicos

Three major airlines have decided they want more business from visitors to Turks and Caicos.

American Airlines has decided to return to scheduled flights to the TCI from their Dallas-Fort Worth hub. This provides easier access for the tourist industry from the southwest and western USA tourist markets.

Delta airlines, with service from their main hub in Atlanta, has indicated they will be using larger aircraft in anticipation of the tourist season.

US Airways, which services the TCI from their Charlotte hub, will soon be operating 18 flights per week.

These three air carriers will be joined this year by WestJet.

According to Trading Markets, “The local airline Air Turks and Caicos, owned and run by a nephew of former Premier Michael Misick, is celebrating the one year anniversary of the buyout of Sky King’s routes. ATC has reportedly suffered a serious loss of business due to competition on the Provo-North Caicos route from high speed ferry operators, who charge less than half the airfare and readily carry quantities of baggage for low fares or gratis while ATC charges by the pound when the weight exceeds limits.”

St Kitts and Nevis Special Olympics

This coming week, the Special Olympics hosts its annual week of activities to encourage support of the events and help fundraising.

Activities begin on Saturday, Nov 7 with a service at the Seventh Day Adventist Church in Molineux. The next day the reigning National Carnival Queen Samantha Boone will give a radio and television address to mark the week of activities open.

On Monday, Nov 9, officials and volunteers will visit schools around the island to raise awareness about the movement and its many accomplishments. A similar message will be shared on national television on Tuesday, November 10, during a feature interview on ZIZ’s Upfront. That day is also designated Appreciation Day.

Other activities include a Tag Day on November 11, a television presentation on November 12, and a street parade on November 13. Events conclude on Saturday, November 14 with a Fun Day at the Paddock at Ponds Pasture at 11:00 a.m.

BVI Hosting Meteorological Meetings

The BVI Airports Authority on behalf of the Government of the Virgin Islands is hosting the 49th session of the Caribbean Meteorological Council (CMC) and its associated meetings on Tortola from November 5-10.

The sessions will attract Government officials and meteorologists from throughout the Caribbean. These meetings are usually rotated around the Caribbean region yearly for discussions on important topics concerning meteorology. The last meeting in the BVI was held in 1983.

The Caribbean Meteorological Organization provides support and advice to governments in the development of their meteorological and hydro-meteorological services and in dealing with issues of an international nature affecting weather, water and climate. It also represents the regional meteorological community’s interests in relation to international civil aviation matters. The CMO works closely with regional agencies involved in disaster preparedness, response and relief.

The British Virgin Islands Airport Authority is currently pursuing the establishment of a full-time meteorological/aeronautical information service office, which when operational will be staffed with meteorologists and a forecaster who will provide, among other things, timely meteorological and aeronautical information to all incoming and outgoing aircrafts.
